Terms of use
Effective October 5, 2026. The French version prevails.
1. Acceptance
These terms govern use of the website of Food Tech (“Food Tech”, “we”) and of the Food Manager software. They are addressed to restaurants and other businesses. By creating an account, connecting a delivery store, or continuing to use the service after you have been notified of these terms, you accept them on behalf of your business.
If a separate written agreement has been signed with us, it prevails where it conflicts. These terms cover everything else.
2. The service
Food Manager is kitchen software. It lets you:
- receive, on one screen, the orders sent by the delivery apps connected to your restaurant;
- show the progress of each order and send the platform the status your staff chooses;
- keep your menu, prices and photos, and send them to a platform when you use that feature;
- manage your team’s access, the kitchen tablet and ticket printing.
We may also create or operate virtual brands from a kitchen. Ownership of that brand, and any revenue share, are set out in the separate agreement for that brand. These terms do not transfer your existing brands.
3. Accounts and security
- You choose who may access your account and which role each person has.
- Each person keeps their password confidential. You tell us promptly about any unauthorized access.
- You are responsible for use of the account, the tablet and the pairing links you hand out.
- We may suspend access that puts the service, or our other clients, at risk.
4. Your responsibilities
You remain the operator of the restaurant. You are responsible for:
- the accuracy of your menu, prices, photos, hours and the store identifiers you give us;
- preparing orders, food safety, and the rules that apply to your establishment;
- what your staff does in the software, including accepting, refusing, cancelling or marking an order ready;
- the contracts you have with Uber Eats, DoorDash, SkipTheDishes or any other platform.
5. Delivery platforms
By connecting an Uber Eats, DoorDash or SkipTheDishes store to Food Manager, you authorize us, for that store, to receive its orders and to send the platform the status updates triggered in the software. Where that platform has the feature, you also authorize us to send it the menu content you have saved.
You remain the merchant on the platform. We are not the delivery service and we do not process the customer’s payment. Store approval, platform rules, platform fees and platform outages belong to that platform. We do not guarantee that a platform will approve the store or stay available.
6. Orders
The software shows the orders the platforms send us and forwards the status your team chooses. An order may be accepted automatically if you have turned that setting on. The decision to prepare, refuse or cancel stays yours. We are not a party to the sale between you and the app’s customer.
7. Menus, photos and brands
You keep your menus, photos and brands. You grant us the right to host them, display them in the software and send them to the platforms you have connected, only to provide the service. You represent that you have the right to use that content and that it does not infringe anyone else’s rights.
8. Personal information
How we handle personal information is described in our privacy policy. For orders, we act on your behalf: you and the platform remain responsible for the relationship with the person who placed the order.
9. Intellectual property
We keep all rights in Food Manager, the website, the software, the documentation and our brands. We grant you a non-exclusive right to use the service for your restaurant while your account is open. You may not copy the software, resell it, or present it to anyone else as your own product.
10. Availability
The service is provided in a professional manner, with the means we have. It may be interrupted for maintenance, an update or an incident. Delivery apps, your kitchen’s internet connection, the tablet and the printer are outside our control. We do not promise uninterrupted operation.
11. Fees
Any fees are those agreed in writing, for example in a quote or a service agreement. Opening an account does not by itself create a paid subscription. Applicable taxes are extra. Fees charged by a delivery platform remain payable to that platform.
12. Liability
To the extent Québec law allows, we are not liable for indirect damages, including lost profits, lost customers or lost orders, or for the consequences of a delivery platform going down. Our total liability for a claim about the service is limited to the fees you paid us for that service in the three months before the claim. If you paid no fees, the limit is one hundred Canadian dollars.
Nothing in these terms excludes liability for intentional or gross fault, or for bodily or moral injury where the law forbids that exclusion. You will defend us against a third-party claim that arises from your food, your content, your brands or an instruction you gave us, to the extent we did not ourselves commit a fault.
13. Ending the service
You may stop using the service at any time. We may close an inactive account, or suspend access for non-payment, misuse or a security risk, with notice when the situation allows it. When the service ends, access to the software stops. Information is then handled as the privacy policy describes. Provisions that by their nature should survive — intellectual property, liability, governing law — remain in force.
14. Governing law and language
These terms are governed by the laws of Québec and the federal laws of Canada that apply in Québec. The courts of Québec have jurisdiction. The French version prevails. The English version is provided to make the terms easier to read.
15. Changes
We may update these terms. The effective date shows the latest version. If a change matters to clients who already have an account, we tell them before it applies. Continuing to use the service after that date is acceptance of the new version.
